JONES ELITE LOGISTICS TERMS AND CONDITIONS

APPLICABILITY: The provisions outlined in this Jones Elite Logistics (JEL) document shall apply to all transportation services provided by JEL, including land transportation via road and rail, as specified on the face of the document, and carried out by JEL and its employees or agents, hereinafter, referred to as JEL.

  1. JEL reserves the right to utilize any mode of transportation or route, including third-party services, for the transportation of goods.
  2. The document serves as a contract between JEL and Customers (Consignors/Consignees).
  3. The terms and conditions stated in this document are supplementary to any specific contract between JEL and the Customer.

 

  1. DECLARATION:

(a) The document is issued based on the declaration provided by the Customers, verbally or in writing. JEL shall not be held liable for any inaccurate declarations.

(b) Customers declare that the consignment covered in the document does not contain any hazardous, flammable, or prohibited items as per existing laws.

(c) In case of any weight discrepancy between the declared weight and the actual weight of a consignment, the differential charges shall be collected from the Customer.

(d) Furthermore, if the rates mentioned in the document are lower than the agreed contracted rates, the customer will charge the differential rates.

  1. DOCUMENTATION:

(a) Customers are required to provide complete and accurate documentation, including details of consignors/consignees such as name, address, contact information, necessary forms, permits, invoices, and other statutory requirements. JEL will not be held responsible for any deficiencies in the documentation, and no claims regarding such deficiencies will be entertained. Customers agree to indemnify JEL for any losses incurred due to inaccuracies in documentation or delays caused by improper documentation.

  1. DELIVERY:

(a) The date of arrival of the consignment at the destination or the first delivery attempt is considered as deemed delivery.

(b) Delivery assurance does not apply in cases of accidents, force majeure events, natural disasters, strikes, or events beyond JEL’s control.

(c) JEL shall not be liable for damages or losses discovered after delivery acceptance. Claims for damages must be made at the time of delivery.

  1. STATUTORY PAYMENTS:

(a) Customers are responsible for all government levies, taxes, and duties imposed on the consignment.

(b) JEL will not be liable for any losses or refunds due to consignments held by statutory authorities.

  1. LIABILITIES:

JEL’s liability is limited to the amounts specified under clauses 10 and 11. Customers are advised to opt for insurance coverage to protect their interests fully.

  1. LIMITATION OF LIABILITY:

JEL’s liability for loss or damage to consignments is determined based on valuation charges or insurance coverage, as agreed with the Customer.

  1. ACTUAL VALUE:

The value of consignments shall be assessed based on repair costs, market value, or the original cost paid by the Customer, whichever is lower.

  1. CONSEQUENTIAL DAMAGES & DELAY EXCLUDED:

JEL is not liable for consequential damages or delays beyond its control.

  1. CLAIMS:

(a) Claims must be submitted in writing to JEL within 30 days of delivery acceptance.

(b) Claims will not be entertained if outstanding charges remain unpaid.

(c) Invoices cannot be deducted for any reason related to claims settlement.

  1. FORCE MAJEURE:

JEL is not liable for losses caused by unforeseeable events beyond its control.

  1. PAYMENTS:

Customers must settle freight and other charges within the stipulated time to avoid interest charges.

  1. LIEN:

JEL retains the right to claim a general lien over consignments for unpaid dues.

  1. UNDELIVERED OR UNCLAIMED CONSIGNMENTS:

If consignees fail to take delivery, JEL will take appropriate action at the cost of the Consignor.

  1. DEMURRAGE:

Charges will be applied for delayed delivery acceptance by consignees.

  1. MATERIALS NOT ACCEPTABLE FOR TRANSPORTATION:

Certain goods, such as hazardous, precious items, perishables, and prohibited items, are not accepted for transportation.

  1. JURISDICTION:

All disputes and matters concerning this document will be subject to the jurisdiction of Bengaluru.
